As clearly explained on our ‘About’ page, Opt Out Today is a project of the Freedom Foundation.
The Freedom Foundation is a nonprofit organization working to advance the principles of individual liberty, free enterprise and limited, accountable government. Through our ‘Opt Out Today’ project, we communicate with public employees to help them understand and exercise their constitutional right to cancel their union membership and dues payments.
However, in 2025, several of Oregon’s most politically powerful unions convinced the state legislature to pass a law targeting Opt Out Today and the Freedom Foundation with the threat of lawsuits based on the absurd premise that our communications “falsely impersonate” unions and union representatives.
Without providing any evidence, the unions accused us of tricking public employees into opting out of union dues and fees by “impersonating” their union.
For example, the unions claimed that because our website and other communications identify each union by name and provide membership and dues cancellation letters addressed to the relevant union officials—both of which are necessary for you to successfully submit your opt-out request to your union—public employees were somehow fooled into thinking that their own union was asking them to cancel their union membership and dues.
To be clear, union leaders do not want you to opt out of the union. Their political and financial power relies on continuing to take dues from your paycheck.
However, the U.S. Supreme Court has affirmed that opting out of union dues and fees is your First Amendment right. Public employees cannot be forced to financially support a union as a condition of employment, and Opt Out Today exists to help public employees understand and exercise this right.
This is precisely why union leaders in Oregon have now targeted Opt Out Today and the Freedom Foundation with the new law. Their goal is to suppress our communications to public employees and ultimately suppress public employees’ ability to make their own decision about union membership and dues.
Although the new law isn’t based on any legitimate evidence of impersonation, it was intentionally written broadly enough to allow unions to file lawsuits against Opt Out Today and the Freedom Foundation anyway, alleging that virtually any of our communications “falsely impersonate” the unions or their representatives.
